Ewidi, the Service Ewidi is a free, public internet service for any person ("User") offered to you by the Ewidi team ("Team"). You may search for messages at Ewidi, publish messages at Ewidi, and get in contact with other users in your private area. Searching for messages is free for everyone. If you want to publish messages and to get in contact with other users you need to register ("Registered User"). In order to register you do not need to give any personal data, only a username (login name) and a password (also known as magic word), nothing else. To get in contact, Registered Users can enter a dialog. The dialog steps are restricted to a number which the Team deems to be appropriate. During this dialog the Registered Users can decide whether they wish to continue their dialog outside of Ewidi. If so they can exchange their contact information before they reach the end of their dialog steps (Maximum number of steps allowed may change from time to time). The service is for your personal use only. It may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Ewidi. Illegal and/or unauthorized use of this service, including collecting usernames and/or contact data like telephone numbers, email addresses, web addresses or real addresses and names for the purpose of unsolicited contacting or unauthorized framing of or linking to the website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed without notice and may result in termination of your account. Appropriate legal action will be taken for any illegal or unauthorized use of the services. The Team's intent is to connect Users with other Users. The Team merely provides this website as a tool allowing the User to do that. The Team shall not participate in any communication between the Users. If you enter into agreements with other Users via Ewidi, the Team shall not be a contracting party in these agreements. The Team shall not be responsible for any agreements between Users. The Team does not warrant that the User may successfully establish contact with any other User. Furthermore, the Team shall not be liable to any User for a breach of duties under these agreements. If there is a dispute between Users, or between Users and any third party, you understand and agree that the Team is under no obligation to become involved. The service can be stopped or any user can be deleted if any part of a published message breaches

The Agreement By using Ewidi you are agreeing to comply entirely with these Terms of Use ("Terms"). These Terms describe your obligations and restrictions regarding your use of Ewidi. Please read these Terms carefully. If you do not agree with them, you should leave this website and discontinue use of Ewidi immediately. These Terms includes Ewidi's Privacy Policy. In order to become an Ewidi User, you must read and accept all the terms and conditions and the Privacy Policy. In the event of any inconsistency between these Terms and the Privacy Policy, these Terms shall prevail. Nothing in these Terms shall be deemed to confer any third-party rights or benefits. If you do not agree to be bound by these Terms, you may not use nor access our services. You acknowledge and agree that it is technologically impossible to achieve 100%-availability of the Ewidi-Websites. Events such as maintenance works, safety, capacity limits or events beyond Ewidi's control (e.g. hacker attacks, network disruptions, etc.), may result in short disturbances or in temporary interruptions of the Ewidi service. Modification of these Terms The Team may modify these Terms at any time and without prior notice. Modifications shall become effective immediately after their posting. You are responsible for checking from time to time the most current version of these Terms of use and of our Privacy Policy. Your continued use of Ewidi indicates your acceptance of these modified Terms. Modification of the Ewidi Service The Team reserves the right to modify or discontinue, temporarily or permanently, at any time and from time to time, the Ewidi Services (or any part thereof) with or without prior notice. You agree that the Team shall not be liable to you or to any third party for any modification, suspension or discontinuance of Ewidi services. Registration If you want to publish messages and to get in contact with other Users, you need to register. Users are entitled to have only one active account in Ewidi at a specific time. In order to register you only need to choose a username (also known as login name) and a password (also known as magic word). Nothing else. We do not ask for neither store any personal data of the user. Password responsibility You will be asked to choose a username (also known as login name) and a password (also known as magic word) in order to register. You are entirely responsible to keep your password secret. If you knowingly provide your login and password information to another person, your account privileges may be suspended temporarily or terminated. You agree to immediately notify the Team of any unauthorized use of your account or password or about any other breach of security. The Team shall not disclose your password to any third party and shall not request the Registered User's password at any other time than during registration and login. The Team cannot and will not be responsible or liable, directly or indirectly, for any loss or damage arising from the User's failure to comply with these Terms. Deleting an account The Registered User may delete his/her account at any time by using the "delete my user" function in his/her private area. The Team has the right to delete or deactivate the account of Registered Users at any time, for any reason, and without notice, including, without limitation, if he/she does not comply with any applicable law or with these Terms. Even after the termination of the account of Registered Users, this Agreement will remain in effect. User behaviour You agree that you are responsible for your own behaviour and published content while using Ewidi and for any consequences derived from them. Content You are solely and entirely responsible for all the content that you publish or otherwise make available via Ewidi. The Team is not responsible for the content made available by you through Ewidi. You agree to publish only messages which comply with your own local laws regarding online conduct and acceptable content. By publishing any content on or through Ewidi, you hereby grant to Ewidi a non-exclusive, royalty-free and fully-paid worldwide license (with the right to sublicense through unlimited levels of sublicensees) to publicly display, use, modify and distribute such content at and through Ewidi. You represent and warrant that for any content you publish, you have the right to grant this license. You represent and warrant that any content you publish does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You may not publish any content for which you do not have the rights to make it available under any law or under contractual or fiduciary relationships. The advertising of any illegal service or the sale of any items whole sale is prohibited or restricted by any applicable law is not allowed. Under no circumstances will the Team be responsible or liable, directly or indirectly, in any way for any content or for any loss or damage of any kind incurred as a result of any content published or otherwise made available via Ewidi. The content does not necessarily reflect the opinions or policies of the Team. The Team does not warrant that published content is true or accurate, nor that it fulfills or serves any particular purpose(s). The Team has the right in its sole discretion to delete any content which is violating the letter or spirit of these Terms or for any other reason. Monitoring and Enforcement The Team assumes no responsibility for monitoring Ewidi for inappropriate content or conduct. If at any time the Team chooses, in its sole discretion, to monitor Ewidi, the Team nonetheless assumes no responsibility for the content, no obligation to modify or remove such content, and no responsibility for the conduct of the User submitting any such content. The User may report any messages of any other user(s) not in compliance with the applicable laws or any of the Terms using the "Report" function nearby every message, in the search result list, or within the "My Ewidi" private area. Scenarios and interpretations may vary, therefore the Team reserves the right not to take any action. Under no circumstances will the Team be liable in any way for any content published in Ewidi. Notification Of Claims Of Infringement If a User believes that a message is infringing any copyright, patent, trademark, trade secret or other proprietary rights of any party or his/her intellectual property rights have been otherwise violated, he/she can inform the Team by using the "Report" function nearby every message, in the search result list, or within the "My Ewidi" private area and provide the Team with additional information. If you assume that one of your patent rights is infringed by Ewidi, please inform us immediately by email at  or use the "Report" function mentioned above so that the issue can be sorted out quickly. PLEASE NOTICE: The more time-consuming engagement of a lawyer to create a caution with costs for the Ewidi Team does not correspond to its real or presumed purpose. Access to Ewidi You also agree not to “frame” or otherwise simulate the appearance or function of this website. The User agrees not to monitor or copy, or allow others to monitor or copy Ewidi or the content included herein. The use of manual or automated software, devices, or other processes to “crawl” or “spider” any web pages contained at Ewidi is strictly prohibited. The User agrees not to take any action that interferes with the proper working of, or places an unreasonable load on, our infrastructure, including but not limited to unsolicited communications, attempts to gain unauthorized access, or transmission or activation of computer viruses. Any use of any of the services and/or contents offered at Ewidi in excess of the scope of use as provided by the Team is inadmissible without the prior written consent of the Team. Indemnification The User agrees to indemnify and hold harmless the Team and all directly or indirectly related persons, companies and institutions from any direct or indirect claims, demands, losses, liabilities and any direct or indirect incidental, consequential, special or exemplary damages including reasonable attorney fees, court costs and expenses (including legal fees), made by him/her or any third party, resulting from his/her use of Ewidi or any information published by him/her, including but not limited to the violation of these Terms or any applicable law. Disclaimer Of Warranties "As Is" The Ewidi service is provided on an "as is" or "as available" basis, without any warranties of any kind. All express and implied warranties are disclaimed to the fullest extent permitted by law. The Ewidi Team cannot guarantee and does not promise any specific results from use of the Service. At your own risk The use of Ewidi and the service is entirely at your own risk. Any material downloaded or otherwise obtained through the use of Ewidi is done at your own discretion and risk, and you are solely responsible for any damage to your computer system or loss of data that may result from downloading any such material. Content & communication among users The Ewidi Team assumes no responsibility for the accuracy or reliability of any communication between users. The Team is not responsible for any incorrect or inaccurate content posted at Ewidi or in connection with the Service provided, whether done by Users of Ewidi or by any of the equipment or programming associated with or utilized in the Service. Displaying content provided by the users does not imply approval or endorsement of this content by the Ewidi Team. Links Content created and posted by Ewidi Users may contain links to other websites. The Ewidi Team is not responsible for the content, accuracy or opinions expressed on such websites, and such websites are in no way investigated, monitored or checked for accuracy or completeness by the Team. Inclusion of any linked website at Ewidi does not imply approval or endorsement of the linked website by the Team. Users accessing these third-party sites do so at their own risk. The Team takes no responsibility for third party advertisements which are posted at Ewidi, nor does it take any responsibility for the goods or services provided by the advertisers. Limitation of Liability In no event shall the Ewidi Team be liable to Users or any third party for any direct, indirect, consequential, exemplary, incidental, special or punitive damages, including but not limited to, damages for loss of data, profits, use or other intangible losses arising from the use of Ewidi, even if the Team has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Ewidi's liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Ewidi for the services during the term of membership. Law restrictions Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. Governing Law Disputes These Terms and the relationship between the User and the Team shall be governed by the laws of the European Community without regard to its conflict of law provisions. The User and the Team agree to submit to the personal and exclusive jurisdiction of the courts located at Brussels. General Information Ewidi and the Ewidi logo and names are trademarks (patent pending) of Ideami. You agree not to display or use these trademarks in any manner without prior, written permission of the Team. Please send us any questions or comments using the feedback function in the Ewidi menubar. The Ewidi application and logos are protected to the maximum extent permitted by copyright laws and international treaties. These Terms constitute the entire and exclusive agreement between the User and the Team. These Terms govern the use of Ewidi by the User, superceding any prior agreements between him/her and the Team. There are no oral or written representations, understandings or agreements relating to these Terms which are not fully expressed in these Terms. If any provision of these Terms is, for any reason, invalid and/or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. The parties agree to replace an invalid and/or unenforceable provision with a valid and/or enforceable provision which most closely approximates the intent and economic effect of the invalid and/or unenforceable provision. |
